Abstract

Purpose: this article examines how transfer pricing disputes are adjudicated and why formal procedure diverges from everyday courtroom practice.
Method: a two-month ethnomethodological engagement in one adjudication panel, combining observation, nine interviews, and document study.
Results: adjudication runs on a uniform procedural layer and a substantive layer specific to transfer pricing; Article 76 sets no floor to the standard of proof, which each panel fills differently.
Novelty: the study reads courtroom practice from inside using social systems theory and indexicality rather than from decided cases.
Contribution: it offers an evidentiary map for the court, the tax authority, and taxpayers.
